Tekna Holding ASA: Appeal concluded in Canada
Reference is made to the notice issued of January 30, 2026 in relation to a decision issued on January 22, 2026 by the Federal Court of Appeal in Canada that unanimously dismissed the appeal filed by AP&C, a subsidiary of GE Aerospace, finding no error in the judgment issued by the Federal Court on June 7, 2024 that found most of the claims of the two Canadian patents asserted against Tekna to be invalid (and all non-infringed). It was further noted in that notice that a separate appeal filed by AP&C of a related decision of the Federal Court (reference 2024 FC 1954) awarding approximately $2.9M CAD in legal costs to Tekna was still pending. Such appeal has now been discontinued by AP&C.
